SR22 Insurance

March 24th, 2017

When you receive a DUI in the state of Arizona, there are several steps you need to take in order to get your driver’s license reinstated.  Along with getting a DUI Screening and applicable classes completed, you will also need to file an SR22 with the Arizona Motor Vehicles Division (MVD).  Why?  What is SR22 Insurance?

Arizona SR22 Insurance is a form filing sent to the Motor Vehicles Division certifying that you have future proof of financial responsibility.  If you have let your insurance lapse or have had your license suspended or revoked for any reason, you will be required to obtain Arizona SR22 Insurance.  Your license may be suspended or revoked due to the following:

• Refusal to submit to a field sobriety test or other test to detect if a person is operating under the influence of alcohol or drugs,

• Driving under the influence of alcohol or drugs,

• Failure to pay penalties for outstanding traffic, moving or speeding violations,

• Reckless Driving,

• Being at fault of an accident that causes serious injury or death to another person,

• Violating traffic laws so often that the state has deemed you to have disrespect for traffic laws and a disregard for the safety of others, or

• Using a driver’s license illegally.

Do I need Arizona SR22 Insurance if I do not own a car?

Yes.  Even if you do not own a car, but have the need for a driver’s license you will need to file an SR22 with the MVD in order to get your license reinstated. This type of SR22 filing is referred to as a non-owners SR22 insurance filing.  A non-owners SR22 policy is a liability only policy.

Your SR22 insurance provider will send the Arizona Department of Transportation a certificate indicating that you have obtained the necessary insurance in order to reinstate your driving privileges.  Please understand that if the court has mandated the installation of an ignition interlock device on any vehicle you drive, you will not be able to obtain a non-owners insurance policy.

How long am I required to carry Arizona SR22 Insurance?

For most offenses, the State of Arizona will require you to carry SR22 Insurance for a period of 3 years unless it is a judgment suspension.  Because the requirement for a judgment suspension vary from case to case, you should contact the Arizona Department of Transportation Motor Vehicle Division and they will review your case and determine the length of time you need to maintain SR22 Insurance.

What is the process to reinstate my Arizona Driver License?

Once your suspension has ended, you can apply to have your driving privileges reinstated.  If you are paying your reinstatement fee with a credit card, you can reinstate your license online.  You can also pay your reinstatement fee in person at any MVD office.  In some cases, your insurance company will need to submit an Arizona SR22 Insurance form before you can reinstate your license.

Reinstating a revocation is more difficult.  Your driving record will need to be investigated before the Motor Vehicle Department will allow you to apply for a new license.  Be aware that the investigation can take up to 30 days.  A telephone call to the MVD will initiate the investigations and you will also need to order the Revocation Investigation Packet.
